Why do I need IME Guardian?
To ensure that the IME examiners prepare a report that accurately depicts what transpired in the examination. The report can be produced later if there is a conflict in the defense IME’s report.
Haven’t you ever heard your client tell you “The doctor never asked me that question” or, “The exam was 5-minutes and she didn't examine me other than to ask a few questions, so how can she write a 5-page report?” Or, your client goes for a Functional Capacity Evaluation that is over 2-hours, and your client tells you “The physical therapist told me to keep working through my pain, and I did, but she didn’t write that in the report, yet said I can do medium level work.”
For all these reasons, having a trained IME Guardian accompany your client to an evaluation gives you the security that another set of eyes and ears are watching and listening.
Why can't someone from my office accompany my client to the DME?
If there is a conflict in how the defense examiner reported the evaluation, it will carry more weight if the conflict is reported by an independent person like an IME Guardian, rather than by your staff or an attorney, who will likely be viewed as biased.
Your time is better spent practicing law and attending IMEs is our business. Also, consider that your client may not feel comfortable undressing in front of his/her attorney or the office staff.
Does the IME Guardian Talk During The Defense IME?
No. The IME Guardian is to remain silent unless the examination requires the IME Guardian to block an inappropriate question, or seek clarification from the examiner if your client does not understand a question, or is confused how to answer. We do not want to impede the exam, just report it accurately.
Does the IME Guardian Tape Record or Video the examination?
No. The IME Guardian takes extensive notes that are put into report format. Under special circumstances, tape recording is appropriate. Know that we record everything that is humanly possible.
Does the IME Guardian sit in on testing administered by a psychologist, neuropsychologist or vocational specialist?
Yes, but circumstances vary by state and according to the examiner. If permitted access to the testing session, the Guardian must remain silent to avoid breaching testing protocol. We never want our presence to distract the examiner or your client.
Is IME Guardian considered an "Expert" service?
No. We do not provide expert witness services. IME Guardians come from a variety of backgrounds, pooling from the professional rehabilitation community. All Guardians are trained on appointment attendance, to observe and record exactly what took place in the IME. We do not challenge IME Expert opinions.
